The Constitution of India is the longest Constitution in the world, which describes the framework for political principles, procedures and powers of the government. The Constitution of India was written on 26 November 1949 and came into force on 26 January 1950. On 26th January 1950, the Constitution of India came into effect. That’s why 26th January is celebrated as Republic Day in India.

How Was the Constitution of India Formed?

The representatives of the Indian people framed the Indian Constitution after a long period of debates and discussions. It is the most detailed Constitution in the world. No other Constitution has gone into such minute details as the Indian Constitution.

The Constitution of India was framed by a Constituent Assembly which was established in 1946. Dr Rajendra Prasad was elected President of the Constituent Assembly. A Drafting Committee was appointed to draft the Constitution and Dr B.R. Ambedkar was appointed as the Chairman. The making of the Constitution took a total of 166 days, which was spread over a period of 2 years, 11 months and 18 days. Some of the salient features of the British, Irish, Swiss, French, Canadian and American Constitutions were incorporated while designing the Indian Constitution.

Features of The Constitution of India

The Constitution of India begins with a Preamble which contains the basic ideals and principles of the Constitution. It lays down the objectives of the Constitution.

The Longest Constitution in the world

The Indian Constitution is the lengthiest Constitution in the world. It had 395 articles in 22 parts and 8 schedules at the time of commencement. Now it has 448 articles in 25 parts and 12 schedules. There are 104 amendments (took place on 25th January 2020 to extend the reservation of seats for SCs and STs in the Lok Sabha and state assemblies) that have been made in the Indian Constitution so far.

How Rigid and Flexible is the Indian Constitution?

One of the unique features of our Constitution is that it is not as rigid as the American Constitution or as flexible as the British Constitution. It means it is partly rigid and partly flexible. Owing to this, it can easily change and grow with the change of times.

The Preamble

The Preamble has been added later to the Constitution of India. The original Constitution does not have a preamble. The preamble states that India is a sovereign, socialist, secular and democratic republic. The objectives stated by the Preamble are to secure justice, liberty, and equality for all citizens and promote fraternity to maintain the unity and integrity of the nation.

Federal System with Unitary Features

The powers of the government are divided between the central government and the state governments. The Constitution divides the powers of three state organs, i.e., executive, judiciary and legislature. Hence, the Indian Constitution supports a federal system. It includes many unitary features such as a strong central power, emergency provisions, appointment of Governors by the President, etc.

Fundamental rights and fundamental duties

The Indian Constitution provides an elaborate list of Fundamental Rights to the citizens of India. The Constitution also provides a list of 11 duties of the citizens, known as the Fundamental Duties. Some of these duties include respect for the national flag and national anthem, integrity and unity of the country and safeguarding of public property.

India is a republic which means that a dictator or monarch does not rule the country. The government is of the people, by the people and for the people. Citizens nominate and elect its head after every five years.

Introduction.

In 1852, abolitionist Frederick Douglass gave a speech on the meaning of the Fourth of July. He addressed the inequalities and injustices for Black Americans that made them feel they did not belong and had no reason to celebrate the holiday. However, he also stated his belief that the Constitution was “a glorious liberty document.” Douglass believed that the document created a constitutional government with the central purpose of protecting liberty and a free society for all Americans.

The Founders of the Constitution wanted to build a new and enduring representative government based on the authority of the people. Important constitutional principles guided their work at the Constitutional Convention during the summer of 1787. The balancing act of including these principles was difficult but necessary to protect the liberties of the people. Given their assumptions about human nature, and always keeping in mind the ideals of the Declaration of Independence, the Founders created a Constitution rooted in sound principles of government.

Human Nature and Limited Government

The Founders’ understanding of human nature determined the kind of government they created. In Federalist No. 51, James Madison asked, “What is government itself, but the greatest of all reflections on human nature?” The Founders believed that humans were flawed but capable of virtue. Therefore, humans must be allowed to govern themselves, but that government had to be limited and controlled by the people, or liberty would be lost.

The Constitution defines the powers of the national government. Some powers are enumerated powers , or specifically listed. Others are implied powers or not explicitly listed. These are powers that relate to other powers and are therefore implied. For example, the power to raise an army for defense implicitly includes the power to raise an air force. The Founders wanted to strengthen the national government over what existed under the Articles of Confederation, but they also wanted to limit the powers of that government.

Republican Government and Popular Sovereignty

Based upon the Enlightenment ideas of John Locke, the Declaration asserted that just governments derive their powers from the consent of the governed and thus laid the basis for American self-government. This is the principle of popular sovereignty , which means the people hold ultimate authority. The authority of the people themselves is the greatest limit on the power of the government. In Federalist No. 39 , Madison defined a republic as a government that derives its powers from the people and is governed by representatives elected by the people to serve for a defined period.

The republican principle of self-government guided the Founders in creating the new constitutional government. The Preamble begins, “We the People,” and lists the guiding principles of government. The Constitution also provides for defined terms of office, including two years for the House of Representatives, four years for the president, and six years for the Senate. The most republican feature of the Constitution is the predominance of the legislative branch, which is closest to the people.

Separation of Powers

The Founders trusted the people and their representatives in the new government but created additional tools to prevent government from amassing too much power. Madison made it clear in Federalist No. 48 that the people cannot rely on mere “parchment barriers,” limits written on paper, to control government. Government is most effectively limited through well-founded institutions. The Founders chose to divide power as the best way to avoid tyranny and to ensure the rights of the people are protected. The Constitution contains many examples of the separation of powers . Each division of government exercises distinct powers to carry out its functions and to prevent the accumulation of power. The Congress is divided into two houses—a House of Representatives and a Senate—in a principle called bicameralism. The national government is divided into three branches with different powers and functions to prevent any one branch from becoming too powerful. A legislature makes the law, an executive enforces the law, and a judiciary interprets the law. Some specific constitutional examples are Congress’s power to declare war, the president’s power to make treaties, and the courts’ power to hear cases resulting from legal disputes. The government is also divided into different levels—national, state, and local—to separate power and limit government. This principle of different levels of government having their respective powers is called federalism .

Checks and Balances

Another central device limiting the power of the national government is the provision for the three branches to check and balance each other’s powers. The Constitution contains many such examples of checks and balances . Congress may pass a law, but the president has to sign or veto it. The president can make treaties, but the Senate has to ratify them. The Supreme Court can review a congressional law or an executive order. Another example is that the House can impeach a president and the Senate can remove a president from office if found guilty in a trial presided over by the chief justice of the Supreme Court. There are numerous other examples that would make a very long list.

The division of power among different levels of government is called federalism. As Madison described in Federalist No. 39 , the Constitution is a mixture of the national and the federal principles. In other words, sometimes the national government has exclusive power, and at other times, the national government shares power with the states. Some examples of federalism from the Constitution include the ratification process for the document itself. The people and their representatives had to decide whether to ratify, or approve, the Constitution in popular ratifying [approving] conventions in the states. The amendment process includes ratification by three-quarters of state legislatures or state conventions. Structuring these processes through the states ensures that approval of and changes to the national government are balanced among the states. Similarly, the Senate equally comprises two senators per state, who were originally elected by state legislatures. The Electoral College gives the states a voice in presidential elections through electors the states choose. These provisions also ensure that though the federal government is supreme, the states have a meaningful role in the system.

In the American federal system, both the national and state governments have sovereignty. In general, the national government is sovereign over national matters, such as national defense, foreign trade, and immigration, while states are sovereign over local matters, including basic rules of public order. As Madison noted in Federalist No. 45 , “The powers delegated by the proposed Constitution to the federal government are few and defined. Those which are to remain in the State governments are numerous and indefinite.” In the federal system, the ultimate power to make decisions for the entire nation rests exclusively with the national government, which, when operating under its proper jurisdiction,is supreme in its enumerated powers. Article VI of the Constitution states that the Constitution, all constitutional laws, and all treaties are the supreme law of the land. More generally, the Constitution empowers the national government to govern for the entire nation. It makes the laws for the country. It makes decisions related to war and peace and conducts relations with foreign nations. It regulates trade between the states and settles disputes among them.

Constitutional Government

American constitutional government is rooted in the ideas of limited government, popular sovereignty, separation of powers, checks and balances, and federalism. These ideas protect the liberties of the people and their right to govern themselves. The Constitution contains words and principles that have the flexibility to respond to centuries of social, economic, and technological change. While the text of the Constitution has words that should be adhered to closely, they are hardly etched in marble. Besides the amendment process that offers a constitutional means of change over time, the American people and their representatives breathe life into the meaning of their Founding documents. They have done so for more than two centuries, through civil dialogue, debate, and deliberation, to reason through the often contested meaning of the Constitution.

History Facts about Dr Bhimrao Ramji Ambedkar

Born on 14 April 1891 in a village named Mhow in the Indore district of Madhya Pradesh, Dr Bhimrao Ramji Ambedkar was also known as Babasaheb Ambedkar. His father Ramji Sakpal, was in the Indian Army, serving the country. With his good work, he was ranked as Subedar in the army. His mother's name was Bhima bai. From the beginning, Ramji encouraged his children to study and to work hard, due to which Bhimrao Ambedkar was fond of studies since childhood. However, he belonged to the Mahar caste, and people belonging to this caste were also called untouchables at that time. The meaning of untouchable was that if any belonging of the upper castes was touched by the people of the lower caste, it was considered impure and the people of the upper caste would not use those things.

Even the children belonging to the lower caste could not go to school for studies due to the poor thinking of the society. Fortunately, the government ran a special school for the children of all the employees working in the army, so B. R. Ambedkar's early education could be possible. Despite being good at studies, he along with all the lower caste children accompanying him were seated outside the class or in the corner of the class. The teachers there also paid little attention to them. These children were not allowed to even touch the tap to drink water. The peon of the school used to pour water on his hands from afar and then they used to get water to drink. When the peon was not there, they had to study and go without water, despite being thirsty.

After Ramji Sakpal retired in 1894, his entire family moved to a place called Satara in Maharashtra, but only after 2 years, Ambedkar's mother died. After this, his aunt took care of him in difficult circumstances. Ramji Sakpal and his wife had 14 children, out of which only three sons and three daughters survived the difficult conditions. And among his brothers and sisters, Bhimrao Ambedkar was the only one who succeeded in ignoring the social discrimination to continue further education, in 1897.

Education of Dr Ambedkar

Ambedkar took admission to Mumbai's high school, and he was the first lower-caste student to get admission in that school. In 1907, Ambedkar passed his high school examination. This success triggered a wave of happiness among the people of his caste because it was a big thing to pass high school at that time and it was amazing to have someone from their community to achieve it.

After that Bhimrao Ambedkar obtained degrees in Economics and Political Science in 1912, breaking all records in the field of studies. In 1913, he went to America for post-graduation and there in 1915 from Columbia University, he did M.A. He was awarded a PhD for one of his researches in the following year. In 1916, he published the book Evolution of Provincial Finance in British India. B.R. Ambedkar went to London in 1916 with his doctoral degree, where he studied law at the London School of Economics and enrolled in the degree for Doctorate in Economics.

However, in the next year, after the scholarship money ran out, he had to leave his studies in the middle and return to India. After that, he came to India and did a lot of other jobs like clerical jobs and the job of an accountant. He completed his research by going back to London in 1923 with the help of his remaining money. He was awarded the degree of Doctor of Science by the University. Since then, he spent the rest of his life in the service of society. He participated in many campaigns for the independence of India, wrote many books for the social freedom of Dalits, and made India an independent nation. In 1926 he became a member of the Mumbai Legislative Council. On 13 October 1935, Ambedkar was made the Principal of the Government Law College and worked on this post for 2 years.

Emerging as a Politician

In 1936, Ambedkar founded the Independent Labour Party which later contested the Central Assembly elections and won 15 seats. Between 1941 and 1945 he published several books, like ‘Thoughts in Pakistan’. In this book, the demand for creating a separate country for Muslims was strongly opposed. Ambedkar's vision of India was different. He wanted to see the whole country without falling apart, which is why he strongly criticized the policies of the leaders who wanted to divide ​​India. After India's independence on 15 August 1947, Ambedkar became the first law minister and despite his deteriorating health, he gave a strong law to India. Celebrations on National Constitution Day

Since the year of 2015 was the 125 th birth anniversary of Baba Saheb Ambedkar, the Government of India decided to celebrate this year in a massive way. For this purpose, a special committee was formed under the chairmanship of the Prime Minister of India, Narendra Modi . Various ministries and departments organized various programs throughout the year with a view to spreading the thoughts and ideas of Baba Saheb. From that day onwards, the status of India changed from “Dominion of India” to “Republic of India”. And that is why since then, 26th January is celebrated as the Republic Day. On this occasion, the National Flag of India is hoisted at various places across the nation and the National Anthem is sung to rejoice the day. Essay on Article 370: Enforcement – (300 Words)

Introduction

Article 370 of the Indian Constitution was drafted in Part XXI of the Constitution: Temporary, Transitional and Special Provisions. However, soon after it came to be known as a permanent feature of the Indian Constitution. It has remained in effect in J&K for decades.

The Origin of Article 370 of the Indian Constitution

Article 370 was drafted by Sheikh Abdullah in the year 1947. Abdullah had been appointed as the Prime Minister of Jammu and Kashmir by Pundit Jawahar Lal Nehru and Maharaja Hari Singh of Kashmir.

Abdullah wanted complete autonomy for J&K and demanded that Article 370 must not remain a temporary provision. However, the Centre deemed this demand unreasonable and did not approve of it.

Special Status Given to Jammu and Kashmir

As Article 370 came into being, the Constituent Assembly of Jammu and Kashmir gained special power wherein it got the right to recommend the articles of the constitution that should be enforced on the state. It even got the power to annul Article 370 altogether.

Article 35 A and Article 370 together stated that a different set of laws apply for the residents of the state of J&K. The Indian Parliament could only exercise laws related to finance, defence, communications and foreign affairs in the state.

It required the approval of state government for applying all the other laws. The residents of J&K enjoyed completely different laws when it came to ownership of property, laws related to citizenship and fundamental rights.

As per the laws enforced by the state, the Indian citizens from other parts of the country were denied the right to purchase property in Jammu and Kashmir.

The residents of J&K fear that the scrapping of Article 370 may hamper their local business and thus be a threat to their livelihood. Adapting to the changes that are likely to follow this big decision also seems to be a cause of concern for the residents of J&K. Their concerns are genuine. We hope the condition of the place improves henceforth.

Essay on Article 370: Advantages and Disadvantages – (400 words)

Article 370 of the Indian Constitution that gave special power to the state of Jammu and Kashmir was annulled on 5 th August 2019. The decision taken by the Centre has been appreciated by several political parties, leaders, celebrities and majority of general public. However, many others have criticized it outright. Article 370 had few advantages and several disadvantages.

Advantages of Article 370 of the Indian Constitution

Here is a look at the advantages of Article 370:

1) Article 370 is advantageous for the citizens of J&K. The state gives priority to the interest of its local citizens. There is less competition in the state and greater opportunities for its citizens.

2) J&K boasts of its local handicraft items. The government of this state has kept its culture and local businesses alive. It has always encouraged local businesses over foreign brands.

This is the reason why several local brands are running in the state. This means more work, greater growth opportunities and good income for the locals.

Disadvantages of Article 370 of the Indian Constitution

Here is a look at the disadvantages of Article 370:

1) The state of J&K hasn’t developed as much as the other parts of the country. This is particularly true when we look at the medical facilities here. The condition of the hospitals and healthcare centres in the state are not that good.

2) The law and order in J&K is weak because the centre is not allowed to intervene. This has given rise to terrorism in the state. Terrorism is a major concern here and nothing much is being done to fight it.

3) Corruption in the state is high due to its alienation from the centre. There is no check on the government of J&K. It makes its own laws and works as per its convenience.

4) Article 370 prevented the implementation of Right to Education in the state. This is why students were forced to move to other states.

5) Outsiders cannot establish business in J&K. Professionals and industrialists are not allowed to settle here. This is a major hindrance in the growth and development of the state.

6) This provision is anti- women in nature. It has led to extreme gender bias in the state.

The disadvantages of Article 370 of the Indian Constitution clearly outweigh its advantages. The atmosphere of tension in the state is a clear evidence of the same. Scrapping of Article 370 seems like a ray of hope for the state that has been gripped by terrorism since long. We hope it sees better times ahead.

Long Essay on Article 370 – (500 words)

Article 370 is a temporary provision in the Constitution of India. It provides special autonomous status to the Indian state of Jammu and Kashmir.

The provisions of the Indian Constitution that are applicable to other states of India are not applicable to J&K.

The article was adopted in November 1956 and was enforced in the state in January 1957 by Sheikh Abdullah.

Special Provisions in Jammu and Kashmir as per Article 370

Some special provisions were made in Jammu and Kashmir as Article 370 came into force in the state. These include:

  • J&K acquired different national flag.
  • Insulting the national flag and national symbols is considered a crime in India. It is a punishable offence. But this rule did not apply in J&K.
  • The highest court orders in India did not apply in J&K.
  • Jammu and Kashmir citizens enjoyed dual citizenship.
  • Women in Kashmir had to abide by the Sharia law.
  • The tenure of the Assembly of J&K was 6 years unlike other Indian states in which the Assembly tenure is 5 years.
  • RTI, RTE and CAG were not applicable in Kashmir.
  • The J&K citizenship of a woman who married a person from another Indian state ended. On the other hand, if a woman from the state married someone from Pakistan, he acquired J&K citizenship.
  • If a Pakistani married a Kashmiri girl, he acquired Indian citizenship.
  • Article 370 did not allow people from other states to purchase property in J&K.
  • The minority group in Kashmir that consists of Hindus and Sikhs did not get 16% reservation.

Changes after the Revocation of Article 370

Now that Article 370 has been revoked, Jammu and Kashmir will no longer enjoy the autonomous status. All the special powers that came with this article have been annulled. Here are some of the other changes that are being brought about:

  • All the residents of J&K shall be entitled to single citizenship only.
  • Article 360 that is enforced during financial emergency is now applicable in J&K.
  • People from other states shall be able to purchase property in J&K.
  • Duration of Legislative Assembly has been changed to 5 years.
  • RTI will be applicable in J&K.
  • Minorities will be eligible for 16% reservation.
  • Children will benefit from the Right to Education.
  • Directive Principle of State Policy shall be applicable.
  • J&K will not have a separate flag.

The Atmosphere in J&K as Article 370 Revoked

J&K’s prominent leaders, Omar Abdullah, Sajjad Lone and Mehbooba Mufti were under house arrest as the bill for abolition of Article 370 was passed in the Rajya Sabha.

Internet and mobile services in Kashmir’s Srinagar district were suspended and a ban imposed on all public gatherings.

With so many changes underway after the revocation of Article 370, it seems like J&K will finally experience peace and prosperity. This is just the first step towards the betterment of the state.

There are miles to go! Whether the decision taken by Centre is right or wrong is still being debated. We hope it proves to be beneficial for the state as well as the country as a whole.

Long Essay on Article 370: Revocation – (600 words)

Article 370 was enforced by Sheikh Abdullah on 26 th January 1957. The article gave special power to the Indian state of Jammu and Kashmir. This was a temporary provision.

However, it remained in force for decades. Even though many political leaders and other prominent people in the country suggested its revocation from time to time, it remained intact; however, it has finally been annulled.

Indian President, Ram Nath Kovind issued constitutional order to revoke Article 370 and apply all the rules and provisions of the Indian constitution to Jammu and Kashmir. This historic move was made on 5 th August 2019.

Bill to Revoke Provisions of Article 370

Union Home Minister, Amit Shah, moved a resolution in Rajya Sabha to introduce a bill scrapping all the provisions of Article 370. This was approved by President Ram Nath Kovind.

Shah also introduced bills seeking bifurcation of the State into Jammu and Kashmir as a Union Territory with an Assembly and Ladakh as a Union Territory without a legislature.

The opposition benches protested against this resolution; however, the decision has been made. Revoking Article 370 of the Indian Constitution had been a major part of BJP’s agenda. Shah’s announcement was thus received with elation by the BJP leaders.

Mixed Reactions on Revocation of Article 370

While many political parties opposed the decision to scrap Article 370 of the Indian Constitution, several others extended their support to the BJP government.

Parties that Supported the Decision

Among those that showed support to this decision were the Aam Aadmi Party,   Bahujan Samaj Party, Shiv Sena, AIADMK, Shiromani Akali Dal, YSR Congress, Telugu Desam Party, Biju Janata Dal, BPF and AGP. All these parties backed the Centre’s decision.

Many of them mentioned that they awaited this move since long and welcome the decision wholeheartedly. They now look forward to peace and development in J&K. The decision of scrapping Article 370 has been termed as bold and courageous.

BSP member, Satish Chandra Misra was among the first ones in the Rajya Sabha to support this move. Mayawati also extended support to the bifurcation of Jammu and Kashmir.

AIADMK mentioned that their leader, Jayalalithaa had always wanted this. Shiv Sena members expressed their joy and support by celebrating outside their party head office.

BJD members said that with this decision, Jammu and Kashmir has become an integral part of the country and they are glad about it.

Parties that Opposed the Decision

The parties those opposed the Centre’s decision to revoke Article 370 include Congress, Trinamool Congress, Nationalist Congress Party, Janata Dal (United), Rashtriya Janta Dal, Left, National Conference, DMK and People’s Democratic Party. All these parties condemned and criticised the resolution.

Congress members mentioned that this was a “catastrophic step” and it should be seen as a “black day” in the constitutional history of our country. It further said that this decision is a publicity stunt by BJP to fetch more votes. Likewise, Left mentioned that it is an attack on the Indian Constitution.

Members of People’s Democratic Party expressed their anger over the decision by shouting slogans and tearing copies of Indian Constitution. National Conference called the decision shocking and unilateral. Trinamool Congress also expressed its objection against the Centre’s decision.

DMK went on to say that this was simply the murder of democracy. It said that BJP is forcing its agenda and that it has no respect for the sentiments of the Jammu and Kashmir residents.

Revocation of Article 370 of the Indian Constitution is indeed a big decision. A major change in J&K is likely underway now. We hope things change for good for this beautiful state which has long struggled for peace and justice. The Centre must make special efforts to resurrect J&K and make it a better and safer place to live.

The constitution of our country is the ultimate shield against all forms of abuse and enabler of powers and rights for Indians. It provides direction to the polity, society and citizenry of India to strive for excellence in the collective conduct and individual behaviour.

Essentially it governs how the government and people interact with each other. After Independence, a constituent assembly was formed to create a document installing the national aims and aspirations as a newly independent country.  

Consequently, they drafted a legal document that encompasses national values and goals. Officially our constitution was enacted on 26 January 1950. 

India constitution stipulates the limits all form of governance and authority, be it state, judiciary or private entities. Due to its detailed nature, it is also the world’s most capacious constitution. Our constitution incorporated inspirations and various provisions from diverse sources.

It has stipulations and adoptions from the Government of India Act (1935), the US constitution, the UK constitution, from countries like USSR, Japan etc. This tradition has been a constant it has always been an organically growing entity, liable to change in light of changing aspirations and circumstances. 

Over the years, the modifications (amendment, repeal etc) have changed the overall nature of our polity adding the descriptions like socialist and secular (42 nd amendment, 1976). 

In terms of governance, it contains information regarding the nature and constitution of the three organs, namely: the legislature (law-making), executive (law enforcing) and judiciary (law maintaining). The state or territory of India, according to the constitution, is a union of different smaller states and union territories (and acquired territories like annexation, enclaves).

These subunits have their own governmental architecture culminating in local administration bodies like panchayats and municipal corporations. This symbiotic relationship is called cooperative federalism.

However, in certain circumstances like war etc. a state of emergency brings the entire nation under one government i.e. the Union. The executive head of the country is the President while the legislature is represented by the Parliament. 

The Judicial system has Supreme Court at its apex and the legislature is constituted with two sub-houses- Lok Sabha (directly elected and nominated parliamentarians) and Rajya Sabha (Indirectly elected+nominated parliamentarians).
