The Supreme Court Got It Wrong: Abortion Is Not Settled Law

In his majority opinion in the case overturning Roe v. Wade, Justice Samuel Alito insisted that the high court was finally settling the vexed abortion debate by returning the “authority to regulate abortion” to the “people and their elected representatives.”

Despite these assurances, less than two years after Dobbs v. Jackson Women’s Health Organization, abortion is back at the Supreme Court. In the next month, the justices will hear arguments in two high-stakes cases that may shape the future of access to medication abortion and to lifesaving care for pregnancy emergencies. These cases make clear that Dobbs did not settle the question of abortion in America — instead, it generated a new slate of questions. One of those questions involves the interaction of existing legal rules with the concept of fetal personhood — the view, held by many in the anti-abortion movement, that a fetus is a person entitled to the same rights and protections as any other person.

The first case , scheduled for argument on Tuesday, F.D.A. v. Alliance for Hippocratic Medicine, is a challenge to the Food and Drug Administration’s protocols for approving and regulating mifepristone, one of the two drugs used for medication abortions. An anti-abortion physicians’ group argues that the F.D.A. acted unlawfully when it relaxed existing restrictions on the use and distribution of mifepristone in 2016 and 2021. In 2016, the agency implemented changes that allowed the use of mifepristone up to 10 weeks of pregnancy, rather than seven; reduced the number of required in-person visits for dispensing the drug from three to one; and allowed the drug to be prescribed by individuals like nurse practitioners. In 2021, it eliminated the in-person visit requirement, clearing the way for the drug to be dispensed by mail. The physicians’ group has urged the court to throw out those regulations and reinstate the previous, more restrictive regulations surrounding the drug — a ruling that could affect access to the drug in every state, regardless of the state’s abortion politics.

The second case, scheduled for argument on April 24, involves the Emergency Medical Treatment and Labor Act (known by doctors and health policymakers as EMTALA ), which requires federally funded hospitals to provide patients, including pregnant patients, with stabilizing care or transfer to a hospital that can provide such care. At issue is the law’s interaction with state laws that severely restrict abortion, like an Idaho law that bans abortion except in cases of rape or incest and circumstances where abortion is “necessary to prevent the death of the pregnant woman.”

Although the Idaho law limits the provision of abortion care to circumstances where death is imminent, the federal government argues that under EMTALA and basic principles of federal supremacy, pregnant patients experiencing emergencies at federally funded hospitals in Idaho are entitled to abortion care, even if they are not in danger of imminent death.

These cases may be framed in the technical jargon of administrative law and federal pre-emption doctrine, but both cases involve incredibly high-stakes issues for the lives and health of pregnant persons — and offer the court an opportunity to shape the landscape of abortion access in the post-Roe era.

These two cases may also give the court a chance to seed new ground for fetal personhood. Woven throughout both cases are arguments that gesture toward the view that a fetus is a person.

If that is the case, the legal rules that would typically hold sway in these cases might not apply. If these questions must account for the rights and entitlements of the fetus, the entire calculus is upended.

In this new scenario, the issue is not simply whether EMTALA’s protections for pregnant patients pre-empt Idaho’s abortion ban, but rather which set of interests — the patient’s or the fetus’s — should be prioritized in the contest between state and federal law. Likewise, the analysis of F.D.A. regulatory protocols is entirely different if one of the arguments is that the drug to be regulated may be used to end a life.

Neither case presents the justices with a clear opportunity to endorse the notion of fetal personhood — but such claims are lurking beneath the surface. The Idaho abortion ban is called the Defense of Life Act, and in its first bill introduced in 2024, the Idaho Legislature proposed replacing the term “fetus” with “preborn child” in existing Idaho law. In its briefs before the court, Idaho continues to beat the drum of fetal personhood, insisting that EMTALA protects the unborn — rather than pregnant women who need abortions during health emergencies.

According to the state, nothing in EMTALA imposes an obligation to provide stabilizing abortion care for pregnant women. Rather, the law “actually requires stabilizing treatment for the unborn children of pregnant women.” In the mifepristone case, advocates referred to fetuses as “unborn children,” while the district judge in Texas who invalidated F.D.A. approval of the drug described it as one that “starves the unborn human until death.”

Fetal personhood language is in ascent throughout the country. In a recent decision , the Alabama Supreme Court allowed a wrongful-death suit for the destruction of frozen embryos intended for in vitro fertilization, or I.V.F. — embryos that the court characterized as “extrauterine children.”

Less discussed but as worrisome is a recent oral argument at the Florida Supreme Court concerning a proposed ballot initiative intended to enshrine a right to reproductive freedom in the state’s Constitution. In considering the proposed initiative, the chief justice of the state Supreme Court repeatedly peppered Nathan Forrester, the senior deputy solicitor general who was representing the state, with questions about whether the state recognized the fetus as a person under the Florida Constitution. The point was plain: If the fetus was a person, then the proposed ballot initiative, and its protections for reproductive rights, would change the fetus’s rights under the law, raising constitutional questions.

As these cases make clear, the drive toward fetal personhood goes beyond simply recasting abortion as homicide. If the fetus is a person, any act that involves reproduction may implicate fetal rights. Fetal personhood thus has strong potential to raise questions about access to abortion, contraception and various forms of assisted reproductive technology, including I.V.F.

In response to the shifting landscape of reproductive rights, President Biden has pledged to “restore Roe v. Wade as the law of the land.” Roe and its successor, Planned Parenthood v. Casey, were far from perfect; they afforded states significant leeway to impose onerous restrictions on abortion, making meaningful access an empty promise for many women and families of limited means. But the two decisions reflected a constitutional vision that, at least in theory, protected the liberty to make certain intimate choices — including choices surrounding if, when and how to become a parent.

Under the logic of Roe and Casey, the enforceability of EMTALA, the F.D.A.’s power to regulate mifepristone and access to I.V.F. weren’t in question. But in the post-Dobbs landscape, all bets are off. We no longer live in a world in which a shared conception of constitutional liberty makes a ban on I.V.F. or certain forms of contraception beyond the pale.

Supreme Court allows Texas to enforce immigration law

WASHINGTON — The Supreme Court on Tuesday allowed Texas to enforce for now a contentious new law  that gives local police the power to arrest migrants.

The conservative-majority court, with three liberal justices dissenting, rejected an emergency request by the Biden administration, which said states have no authority to legislate on immigration , an issue the federal government has sole authority over.

That means the law can go into effect while litigation continues in lower courts. It could be blocked at a later date.

Texas Gov. Greg Abbott, a Republican, hailed the court order , calling it "clearly a positive development," though he acknowledged that the legal battle is not over.

White House press secretary Karine Jean-Pierre said in a statement that the law "will not only make communities in Texas less safe, it will also burden law enforcement and sow chaos and confusion at our southern border."

“The court gives a green light to a law that will upend the longstanding federal-state balance of power and sow chaos,” liberal Justice Sonia Sotomayor wrote in a dissenting opinion. Justices Elena Kagan and Ketanji Brown Jackson also objected to the decision.

The majority did not explain its reasoning, but one of the conservative justices, Amy Coney Barrett, wrote separately to note that an appeals court has yet to weigh in on the issue.

"If a decision does not issue soon, the applicants may return to this court," she wrote. Her opinion was joined by fellow conservative Justice Brett Kavanaugh. The court has a 6-3 conservative majority.

In response to the Supreme Court order, the New Orleans-based 5th U.S. Circuit Court of Appeals fast-tracked oral arguments on the Biden administration’s effort to block the law. Arguments are set to take place Wednesday morning, meaning a decision could come quickly.

The law in question, known as SB4, allows police to arrest migrants who illegally cross the border from Mexico and imposes criminal penalties. It would also empower state judges to order people to be deported to Mexico.

A top Mexico official said Tuesday in a statement on X that the country will not accept deportations from Texas.

According to a spokesperson for the Texas Department for Public Safety, there is no start date yet for enforcement of the law. Lt. Chris Olivarez said that state officials have been planning for its implementation for months, but they’re still discussing some practical details.

In Val Verde County on the U.S.-Mexico border, Sheriff Joe Frank Martinez said his small force, with three deputies on duty around the clock for a 3,145 square mile county of 47,586 people, will not start arresting migrants until he receives guidance from the state.

“I think that we all are in uncharted waters,” he said Tuesday.

He said not only is he not sure how and when to initiate enforcement of the state law, but that he will likely need more deputies and jail space if tasked with the new enforcement initiative. The county jail has a daily capacity of 94, Martinez said.“Right now we’re not equipped to handle that,” he said.

The dispute is the latest clash between the Biden administration and Texas over immigration enforcement on the U.S.-Mexico border.

In a separate opinion, Kagan wrote that the Texas law appears to conflict with federal law, noting that "the subject of immigration generally, and the entry and removal of noncitizens particularly, are matters long thought the special province of the federal government."

A federal judge blocked the law after the Biden administration sued, but the New Orleans-based 5th U.S. Circuit Court of Appeals said in a brief order that it could go into effect March 10 if the Supreme Court declined to intervene. The appeals court has not yet decided whether to grant the federal government's request to block the law.

On March 4, Justice Samuel Alito issued a temporary freeze on the law to give the Supreme Court time to consider the federal government’s request.

Solicitor General Elizabeth Prelogar said in court papers that the law is “flatly inconsistent” with Supreme Court precedent dating back 100 years.

“Those decisions recognize that the authority to admit and remove noncitizens is a core responsibility of the national government, and that where Congress has enacted a law addressing those issues, state law is preempted,” she wrote.

The appeals court, Prelogar added, did not explain its reasoning for allowing the law to go into effect.

She dismissed Texas’ argument that its law can be defended on the basis that the state is effectively battling an invasion at the border under the State War Clause of the Constitution. The provision says states cannot “engage in war, unless actually invaded” or in imminent danger.

“A surge of unauthorized immigration plainly is not an invasion within the meaning of the State War Clause,” Prelogar wrote.

Defending the law, Texas Attorney General Ken Paxton said in court papers that the measure complements federal law and the state should be allowed to enforce it.

The Constitution “recognizes that Texas has the sovereign right to defend itself from violent transnational cartels that flood the state with fentanyl, weapons, and all manner of brutality,” he added.

Texas is “the nation’s first-line defense against transnational violence and has been forced to deal with the deadly consequences of the federal government’s inability or unwillingness to protect the border,” Paxton said.

The city of El Paso and two immigrant rights groups, Las Americas Immigrant Advocacy Center and American Gateways, have also challenged the law and filed their own emergency request at the Supreme Court.

In 2012, the Supreme Court invalidated provisions of a tough immigration law enacted in Arizona. Only two of the justices who were in the majority in that case are still on the court: Chief Justice John Roberts and Sotomayor.

Federal appeals court keeps hold on Texas' sweeping immigration in new ruling

AUSTIN, Texas — In a decision late Tuesday, a federal appeals court extended a temporary block on Texas' new sweeping and controversial immigration law that would authorize state and local police to arrest and deport people suspected of being in the United States illegally.

Maintaining the status quo after a seesaw of judicial opinions in the past week , the New Orleans-based appeals court will keep the law from taking effect ahead of an April 3 hearing on its legality. The U.S. Justice Department has sued Texas over the law, arguing that the state-level immigration policy is unconstitutional as it oversteps into the federal government's authority.

In the Tuesday night decision, the court walked through a number of issues it must contend with in ruling whether the law is constitutional, including the federal government's standing to prevent the Texas law from ever taking effect, conflicting state and federal positions on granting asylum, and concerns that individuals removed under the law would be forced to relocate to Mexico regardless of their country of origin.

The Texas law was allowed to take effect for several hours last week, after the U.S. Supreme Court reversed its hold on the law , allowing an earlier ruling by a three-judge panel of the appeals court to take effect and clearing the way for the law to be enforced. Later the same day, the 5th U.S. Circuit Court of Appeals reversed its prior ruling, again placing the Texas immigration law on hold.

"For nearly 150 years, the Supreme Court has held that the power to control immigration — the entry, admission, and removal of noncitizens — is exclusively a federal power," the appeals court panel wrote in its 2-1 decision to keep the law on hold. "Despite this fundamental axiom, SB 4 creates separate, distinct state criminal offenses and related procedures regarding unauthorized entry of noncitizens into Texas from outside the country and their removal."

Order prevents Texas from arresting migrants who illegally enter U.S.

Ruling in favor of keeping the hold in place Tuesday, Chief Judge Priscilla Richman and Judge Irma Carrillo Ramirez wrote that there is "no basis in the precedent" to keep the Justice Department from seeking to enjoin the law. The judges added that contradictory and repetitive provisions housed in the law step on existing federal immigration processes while neglecting precedent established by the Supreme Court.

The majority opinion also said that provisions of the law criminalize behaviors that are already prohibited under federal law. Richman cited previous Supreme Court opinions from a 2012 immigration case based on an Arizona law, indicating that Texas will fall short in demonstrating why its law should be allowed to take effect as deliberations continue.

In an amicus brief filed last week, Mexico's federal government railed against Texas' law and said it creates "an atmosphere of uncertainty, fear and vulnerability." The government added that the law also denigrate its bilateral relationship with the United States, subjecting Mexicans to criminalization for "looking Latino."

The Texas Legislature passed the law in November to codify a series of penalties for anyone suspected of crossing into Texas from Mexico other than through an international port of entry. The law allows the state's police to arrest migrants suspected of entering the United States illegally and to force them to accept a magistrate judge's deportation order or face stiffer criminal penalties for noncompliance.

The law — which Gov. Greg Abbott signed in December — was scheduled to take effect on March 5, but its implementation was delayed after the Justice Department and civil rights groups sued Texas.

In securing an initial hold in February, federal prosecutors have continued to argue that the law is out of the bounds of state authority and seeks to usurp federal power — a position that has now been presented in front of the Supreme Court.

Texas law threatens 'basic civil and human rights'

In a joint statement Wednesday morning, groups involved in the case — including the ACLU, the ACLU of Texas, Las Americas Immigrant Advocacy Center, American Gateways, the Texas Civil Rights Project and El Paso County — celebrated the 5th Circuit's decision to keep the "cruel, harmful, and blatantly illegal" law from taking effect as the courts weigh its constitutionality.

"We appreciate the decision to keep this unconstitutional and extreme anti-immigrant law from going into effect. SB 4 threatens our most basic civil and human rights as citizens and noncitizens alike," said David Donatti, senior staff attorney for the ACLU of Texas. "We will continue our efforts to prevent this hateful law from ever harming our state.”

But in dissenting with the 5th Circuit panel's 2-1 decision, Judge Andrew Oldham said he would have allowed the law to take effect. Oldman argued that not all elements of the Texas immigration policy are unconstitutional and federal attorneys will unlikely to be successful making that argument.

Oldham said the argument for blocking the law "is based on hypotheticals," and that Texas lawmakers and judges should be allowed to "retain at least some of its sovereignty."
