One of the most effective ways to prepare for a job interview is practicing your answers to common interview questions. There are many factors to consider when getting ready for an interview , but the words you use and how you structure your answers are important.

In this article, we explore why job interview practice is important and how to prepare for some of the most common interview questions.

Why Interview Practice Is Important

Before we get into details about some of the most common interview questions, here are some quick reasons why practicing for a job interview can be helpful:

  • Practicing your answers will help you feel more comfortable talking about yourself. Not all of us are naturally gifted when speaking at length about our career accomplishments. As you practice, you will start to sound - and feel - more comfortable. This is one of the few times in life when you’re expected to brag, and practicing your answers ahead of time can make it feel less awkward.
  • You will already have an idea of the main points to cover. It’s smart to go into an interview with a list of your best talking points ready to go. Having that list memorized will help you present yourself in the best possible way. One note of caution: don’t force your main points into an answer if they don’t address the question directly. You’ll likely have a few minutes at the end of the interview to summarize, so you can save your best selling points for that time, if needed.
  • Practicing out loud helps you decide which words to use. If you’re going back-and-forth about how to describe something, practice it by saying the words out loud. After hearing the words spoken, rather than reading them on a notepad or a computer screen, you may decide to go in a different direction. Using words that are a natural part of your everyday language will help you sound more confident.

Preparing for Common Interview Questions

In the section below, we’ve included some practice interview questions that are likely to come up in any industry.

“Tell me about yourself.”

Many interviews start with some variation of an open-ended statement like “Tell me about yourself.” Make sure to spend some time preparing this opening statement, as it will set the tone for the rest of your answers.

Your goal for this statement is to summarize your career, not to tell your life story. Don’t go into too much detail, as you’ll have opportunities for that later in the interview. Plainly state how the experience and skills you’ve gained in the past have prepared you to succeed in this position in the future.

Also, be careful not to stray too far from the requirements of the position to which you’re applying. You may have a varied background in a lot of industries, and those are all certainly a part of your career story, but try to stay on track by focusing on the connections between your previous work and what the employer is seeking for the position.

Finally, avoid bringing up personal information. There may be appropriate times to talk about your family or your interests outside of work, but those will likely come much later.

“What are your strengths and weaknesses?”

When interviewing, you will likely be asked to identify your strengths and weaknesses . Describing your strengths is an opportunity to return to the main points you want to hit on about why you’re a strong fit for the position. Talk about your natural abilities, the skills you’ve developed, and the wisdom you’ve gained from previous experience. These can all be considered strengths.

Discussing your strengths is also an excellent opportunity to use examples. It’s one thing to claim that you are a strong salesman, but it’s another to bring up specific sales numbers and describe how you improved upon the work that was done at your organization before you arrived.

When discussing your weaknesses, be honest. Don’t fall into the trap of using clichés like “I work too hard.” After stating your weaknesses, describe what you’re doing to improve. Maybe you’re starting to use new tools to help you stay organized, or maybe you’re reading books to help you develop your skills as a manager. Be prepared to talk about how you’re trying to get better.

Behavior-Based Questions

Most interviewers will also ask behavior-based questions . Answers to these kinds of questions can be helpful to a hiring manager because past behaviors can be good indicators for future performance.

Here are some examples of behavior-based questions often asked in job interviews:

  • Describe a time when you were faced with a stressful situation at work. How did you overcome the situation?
  • What’s an example of a goal that you set, and what did you do to accomplish it?
  • Provide an example of a time when you had a problem with a co-worker or supervisor. How did you resolve the situation?

In many cases, interviewers are expecting candidates to use their answers to describe their soft skills like teamwork, communication, conflict management, leadership and more. These are qualities that are difficult to express in a resume, but an interview is a perfect time to try.

When preparing your answers, one popular method for how to structure them is the STAR method . The acronym STAR stands for situation, task, action, result. Remembering these four words when answering a behavior-based question can help you ensure that you’re answering it as completely as possible.

Some of us get so excited when writing essays, like that of a job interview, but one thing we must remember is to summarize the job interview essay   We often forget that an essay is nothing but a short summary of what we wish to write. But that’s okay. It’s nothing different. But unlike some of the essays you may be used to, there are some things to avoid when writing for a job interview essay. Here are some of the things you need to avoid at all cost.

  • Lying about your answers – when writing about what is asked, be careful. Interview questions in an essay may be tricky. Do not make up anything to make your essay sound nice. The interviewer would not be amazed one bit if you lied in your essay. Rather, there is a bigger chance they will not accept you.
  • Flowery words – Most of us are guilty with this when writing the essay. It is best to avoid putting flowery words to make it sound like we did these things. Again, your employer has a way of knowing you are being truthful or lying. Avoid this at all costs.
  • Too proud – this is often taken for granted but I want to put it right here. Do not boast about the experiences you may not have and write it off as yours. Do not boast about the experiences you have in your essay. You have to remain open and humble.

Things You Should Remember When Writing an Essay

  • Voice – keep it professional. The tone in your essay has to be in a professional setting. If you write in a childish manner or as if you are angry at someone, your employer or anyone reading it will surely see that you are not fit for the job.
  • Information – write what is asked in the essay. Do not put any other information that is not required nor needed. Example for this information is through a question that goes like this “why should we hire you?” This may sound easy but be very careful as to what you are going to write or say. Do not forget to introduce yourself in your essay.
  • Explaining – In some questions in an essay, you are required to explain. Like the sample question above, you must give an explanation in your own words as to why they should hire you. However, avoid saying explanations like “because I am the best”, “I am better than anyone.” This will not only make you lose your opportunity, it is also very rude to tell that to your employer.
  • Descriptive – keep your essay as  descriptive as possible . When you are to general in your writing, you are making the person reading confused. Put a little effort to what you are writing.
  • Be prepared – when you are going to a job interview, always expect the unexpected. Answer questions as honest as possible.
  • Reflect – reflect on what you have written . Understand what you have learned and done. A job interview essay is simply one of many essays you are going to go through.

I want to write about my experiences related to the job, should I write down everything?

Yes you may. As long as you remember that what you are writing is true and correct. As well as be careful on how you word it. Your tone in writing should be professional.

Why am I not allowed to show off my skills in my essay?

Employers are interested in what you have, but they are not interested in the way you talk about it. They prefer to see someone professional talking about their experiences in the same professional tone. Rather than being too cocky.

To many firms, the interviewing process has always been a challenge to most of the human resource personnel in charge of this section in the employee recruitment process. As a result most of the organizations try to take the initiative of improving employees by taking their human resource personnel through the appraisal process.

This process is aimed at improving the employee’s ability and efficiency in carrying out an interview that enables the organization to recruit the desired individual with the desired skills.

In this appraisal session, the trainer uses speeches to communicate with his/her audience, giving out brochures and video clips were necessary to explain his points (Laakmann, 2011).

It is first of all necessary for the interviewer to be prepared before the actual interview is started in order to ensure that the best candidate is selected with minimum errors. To start with the interviewer should be on the right track, he/she must be able to identify the goals of the interview and understand them clearly.

This may be formulated through the identification of the present state of the firm, its needs in terms of the manpower, the quality and integrity of the preferred personnel. The interviewer should further be able to estimate the expected expenditure in the process, and expressly specify the estimated cost to be incurred on the employed personnel by the firm.

This should be estimated based on what the firm can be able to afford at the time as salary to the additional employees, and the anticipated productivity of the individual to the output of the organization (Laakmann, 2011).

After the preparation of this information, it should be passed to other colleagues in order to improve the performance and coordination of the team of interviewers.

As the team of interviewers, we should be able to review the material presented by the applicants taking note that a resume will always give more information about the applicant than an application letter.

The next step includes the systematic classification of all the application letters and resumes initially received from the prospective interviewees, following the posting of the job in an advertisement (Glasser, 2007). The material should be screened for consistency of information between the application letter and the resume.

At this stage of the process, the personnel should be able to avoid generalization errors like the qualifying of unnecessary courses done by the some of the candidates.

To create some level of order in the whole process, the documents of the candidates are then classified in to three groups. Group A (qualified), Group B (meet minimum requirements) and Group C (does not meet qualifications).

The collection of documents that are categorized as qualified are then re-reviewed to determine the best candidates that should be taken through an interview. While the rest are kept as contingency applications that may be used in case the person initially selected fails to turn out as expected.

Several other methods may be used by the interviewer in the selection process of the preferred candidate, for example, a telephone interview (Cosentino, 2011).

This may be done with utmost discretion by avoiding asking irrelevant questions that may not be related to the job, to minimize on the risk that may arise for example, the discrimination acts that may be due to asking questions about the interviewee’s race.

The next process is the actual interviewing process between the representative of the company or the employer himself with the candidate.

To begin with, the human resource department of the firm may call the applicants directly themselves, or schedule the interviews through the use of recruitment specialists.

However, there are some general guidelines that may be used by the firm to ensure good results are achieved (Cosentino, 2011).

  • In the scheduling of the interviewing process, the interviewees should be allotted equal time for the process without any form of discrimination. This ensures that the process is fair and just to the interviewees.
  • Adequate time should be allowed between two consecutive interviews, this will help the interviewers to get enough time to arrange the details of the completed interviewee. Simultaneously, sufficient time should be allocated for candidates going and coming to the office to do so freely.
  • The candidates should be informed before they come for the interview about the venue, the specific time and the day of the interview. This will enable the interviewee to plan their activities and allocate adequate time for the interview.
  • The applicants should be well informed about the company before they come for the interview, this will be a sign of interest in the company and its activities. In return they will understand company activities and what to expect from the employment.
  • The candidates may further be instructed to bring job related documentations such as, the work models or recommendation letters where applicable.

Several methods may be used by the firm to get more information from the candidate that can help in the selection process like the use of questionnaires, or direct questions asked by the interviewer. At this point fliers of some of the questions are distributed to the audience.

In most of the companies, the interviewing process is done through question and answer sessions between the interviewer and the candidate; however, these questions must be well devised for them to retrieve the desired information from the candidate on his/her abilities (Cosentino, 2011).

Using direct questions like those that require a yes or no answer should be limited as they restrict information obtained from the candidate. The interviewer should use open ended questions like; tell me about your worst experience?

These types of questions are the best to be used as they challenge the candidate to tell what he/she thinks is important and necessary in the prevailing circumstances. The answers are then used by the interviewer to judge the credibility and potential of the interviewee.

He/she may also make use of the situational questions that help to imply the type of reactions to expect from the applicant. These give the candidate the challenging context of the job like situation.

The answers offered by the candidate are then used to assess their ability to identify the imperative circumstances in the job, analyze them, and provide reasonable solutions (Darling, 2009).

Besides, some of the questions may be applied with the intention of getting general information about the candidates; these are recommended for use for a start up organization or first interviews before the final one is done (Posegate, 2008). Several of the questions may include;

Questions used to identify previous work experience, for example.

  • What are some of your key functions and responsibilities in your current job?
  • Identify a time in your employment that you worked and achieved all you could?

Questions used to establish the expectations of the interviewee on the Job being applied.

What are the reasons that made you to apply for this position?

Why do you think you should be hired for this position?

Questions used to identify the candidate’s attitude towards management.

What do you think are the most significant roles of a manager?

Describe the type of directions that you prefer from a supervisor?

Identification of the employee’s interpersonal skills, with reference to what the firm needs.

  • How do you convince others to do what you want? Have you ever had conflict with the boss? How did you approach her/him and what solutions did you get? Were you satisfied with the solution?
  • We need for you to describe a situation where you have a project in mind and you lack the necessary cash, how will you persuade your employer to grant you the cash.

In some of the jobs, the firm may need someone who is creative and the only way to identify if for sure that person is creative is the use of questions whose answers require a creative mind. For instance, asking the candidate to explain what he has done to improve the level of efficiency, effectiveness and ways to make work easier in his/her initial occupation (Glasser, 2007).

Furthermore, in the assessment of whether the interviewer has a vision or not and his ability to understand the needs of the company, the interviewer may use questions like; have you ever been offered the position of leading a project? Explain how you were able to create and introduce direction in the team?

Some positions in the firm may need an individual with good leadership abilities and the necessary influence on other people through inspiration of others, charisma and spurring. This kind of person may be identified through the use of well formulated questions, that lead to well thought out answers, for example, describe your approach to decision making and problem solving that make you unique?

Or if you were to recommend for the transfer of certain functions from one department to another, what are some of the main factors that you will consider? These questions give the interviewee the chance to display his ability to make quick and creative solutions to the normal challenges that arise in the day to day work environment (Darling, 2009).

After all the interviews have been done and the desired individuals have been identified. The personnel are supposed to develop a list of job related questions that should be used to verify the referees of all the candidates.

Departments should carry out their own checks where necessary and if external help is required, one should conduct the staff recruitment specialists. We verify the interviewee’s referees for the following three reasons;

  • To confirm employment;
  • To substantiate new skills learned during the interview.
  • To obtain employment recommendation.

On the completion of the above procedures, a formal job offer is presented to the candidates. This is done later in form of an engagement letter and contract of employment based on the terms of the specific industry in which the firm operates (Posegate, 2008).

The Importance of the Job Interview Essay Example

Interviews give you a preview of the work environment, one is eager to be involved. They show you how your colleagues will act and how inclusive they will be. First impressions are key for understanding how a person conducts themselves and how they treat others, so be sure to keep an eye on this and an open mind. The obvious ways to see this response would be by analyzing their mannerisms, the setting, and flexibility. 

First, if they are speaking down to you and causing you to feel intimidated, that is a negative sign. Yes, while they do have the authority and control of the interview, there is no reason for them to make it seem as if you are not a person. If they are unable to communicate in a terms known or even elaborate on the unknown terms for you to understand, imagine how training will go. An interview is a formal event, but it should be noted that causing one to feel confused and have an internal conflict afterward is a bad sign. While applying to larger-sized companies and they are too on a schedule, they should not brush you off or make you feel as though you are needed. The process should be smooth and feel like there are plenty of open lines of communication. It is a professional chat between two people that have mutual respect and benefit for each other. 

Second, when entering the interview room and you notice that there is one table with chairs on either side, it creates a formal and professional setting. That would cause one to be a bit nervous, but the feeling would subside once you begin to chat. The single-level creates equal or mutual ground and not a power imbalance. The interviewer is ensuring that the environment is welcoming and assists in creating a positive space for both parties to calmly speak and come to an understanding. However, if two tables create separation and distance between you and the interviewer beings to show the lack of inclusiveness of the workplace. When placed in an uncomfortable position and made to feel like every move is being overly criticized it shows how toxic the work environment will be. The power dynamic is seen clear as day, shifting the energy and creating a negative atmosphere. 

Third, most companies have their own set of protocols and policies for availability and vacation. When asked about either topic, honesty is the best policy. Always let it be known that you have a commitment to your agenda and are willing to compromise if it is possible. Never bite off more than you can chew or allow yourself to burn out for the sanity for the sake of the company. The correct place would understand and attempt to accommodate your needs if their requirements are satisfied. On the contrary, if you are interested in the job and have gotten through the interview without a hiccup, and they begin to ask for complete commitment and will not compromise. That is a major red flag. Everyone has their agenda but if they are unwilling to hear you out or compromise now. It is hard to believe that they will be capable of doing so down the road once you have started working. Your future job is important but should never overshadow or dictate your whole life. 

In conclusion, interviews are the gateway to contracting a job, but they are also the first red flag to be seen. They show us the company's true intentions without us having to sign our lives away. It can be hard to find a job that is practical, interesting, and worth our time. However, at the moment do not waste your time in a conflicting job environment. There will always be hardships and long hours, but it should be for a job that is not beneficial to you. Keeping a lookout for simple factors such as the form in which they act, the environment, and their understanding.

The Republican-controlled House voted this week to impeach Homeland Security Secretary Alejandro Mayorkas over the Biden administration’s handling of the U.S.-Mexico border.

The 214-to-213 vote marks the first time in nearly 150 years that a Cabinet secretary has been impeached.

House Republicans have spent months investigating the secretary’s actions as they’ve aimed to make immigration and border security a key election issue.

Here’s a look at how the House arrived at the impeachment vote and what could happen next:

Didn’t they vote on this last week?

Yes. House Republicans tried to impeach the secretary on Feb. 6 but failed. With Democrats united against the effort, Republicans needed every vote they could muster from their razor-thin majority. But in a rowdy, dramatic evening, Republicans fell short, with three voting against the measure . A fourth flipped his vote from yes to no in a tactical move that allowed the impeachment issue to be revisited, so the final vote was 214-216.

California Republican Rep. Tom McClintock bucked his party to vote against impeaching Homeland Security Secretary Alejandro Mayorkas.

But Republicans vowed to bring the impeachment vote back again.

What’s going on at the border?

Migrants have long come across the southern U.S. border looking for a new life in the United States, but not like what’s happening now. Arrests for illegal border crossings from Mexico reached an all-time high in December. In fiscal year 2022, the U.S. Border Patrol encountered 2.2 million people crossing the border illegally. You have to go back decades to see comparable numbers.

Statistics aren’t always a perfect measure, though, and they can change. The numbers from the 1990s and 2000s are considered vast undercounts because migrants sought to evade authorities as they entered the U.S. And after the dramatic highs of December, the numbers fell by half in January.

Decades ago, the typical migrant trying to come to the U.S. was a man from Mexico looking for work, and he tried to avoid Border Patrol agents. That dynamic has changed drastically. Migrants now are still coming from Central and South America, but they’re also coming from much farther away — China, Afghanistan and Mauritania, to name a few countries. And they’re often seeking out Border Patrol agents, not evading them, in an effort to seek protection in America.

The numbers have at times overwhelmed the ability of border officials to handle them, leading to temporary closures of border crossings so officials can process migrants.

They have also had repercussions far from the border. Migrants going to cities such as Chicago, New York, Boston and Denver have strained municipal services, leading to Democratic officials pushing the administration to take action.

What do Republicans say?

Republicans have laid the blame for all of this on the Homeland Security secretary and said that because of it, he needs to go. They say the Biden administration has either gotten rid of policies that were in place under the Trump administration that were deterring migrants or that the Biden administration implemented policies of its own that have attracted migrants.

The House Homeland Security Committee has been holding hearings over roughly the last year in which Republicans have repeatedly lambasted Mayorkas. Witnesses have included an Arizona sheriff, families who have lost loved ones to the fentanyl crisis, experts on constitutional law, and former Homeland Security officials who served under former President Trump.

House Republicans say the secretary is violating immigration laws by not detaining enough migrants and by implementing a humanitarian parole program that they say bypasses Congress to allow people into the country who wouldn’t otherwise qualify to enter. And they allege that he’s lied to Congress when he has said things like the border is secure. All of this together, they argue, has created a prolonged crisis that is having repercussions across the country, is squarely the secretary’s fault and warrants impeachment. However, the three House Republicans who voted against impeachment argued that the charges didn’t meet that bar.

What do Mayorkas, his supporters and others say?

Democrats and many legal experts have said that this is essentially a policy dispute and that Republicans just don’t like the immigration policies that the Biden administration, via Mayorkas, has implemented. That’s an issue for voters to decide, not one that meets the level of “high crimes and misdemeanors” required to impeach a Cabinet official, they argue.

“That one congressional party disapproves, even disapproves vigorously, of President Biden’s policies on immigration or other matters within the secretary’s purview does not make the secretary impeachable,” testified University of Missouri law professor Frank O. Bowman during a January committee hearing.

Mayorkas and his supporters have often said that it’s not the actions of the administration that are drawing migrants to the southern border, but rayher that it is part of a worldwide phenomenon of migrants, driven by political, economic and climate turmoil, who are more willing to embark on life-threatening journeys to seek a better life.

Mayorkas interview: DHS head talks about impeachment, border and growing up in L.A.

At Homeland Security headquarters, Mayorkas told The Times about his Los Angeles upbringing, his thoughts on the impeachment vote and the challenges before him.

They argue the administration has tried to deal with the chaos at the border. Over roughly the last year, Mayorkas has been the public face of a policy that seeks to create pathways for migrants to come to the U.S. legally. such as an app that lets them schedule a time to come to the border and seek entry. And, they argue, that policy has new efforts to limit who can get asylum and to order aggressive deportations.

But the Biden administration and supporters contend that the secretary is dealing with a wildly underfunded and outdated immigration system that only Congress has the power to truly fix. So far, they argue, it hasn’t.

What happens next?

Mayorkas still keeps his job. It’s the Senate that decides whether an impeached official is convicted and thus ousted from their position.

But conviction is a much higher bar than impeachment. Democrats control the Senate 51-49 and two-thirds of the Senate must vote to convict as opposed to the simple majority needed to impeach in the House. That means all Republicans as well as about a dozen Democrats would have to vote to convict Mayorkas — a highly unlikely scenario considering some Republicans are cool to the idea of impeachment.

Mayorkas has said he’s ready to defend himself in the Senate if it comes to a trial. And in the meantime, he says he’s focused on his job.

Release of Hur Report Underlines Perils of the Special Counsel’s Job

Critics have called Robert K. Hur’s descriptions of President Biden’s memory outside his purview. Others say his narrative was probably motivated by seeking to justify not charging Mr. Biden.

In January 2023, Attorney General Merrick B. Garland appointed a special counsel to investigate President Biden’s handling of classified documents to avoid any perception that he was protecting his boss entering an election year.

The man Mr. Garland tapped for the job, Robert K. Hur, has not been quite as cautious.

On Thursday, Mr. Hur, 50, a former Justice Department official in the Trump administration, dropped a 345-page political bomb into the middle of the 2024 campaign, the final report summing up his investigation. The document, written in unvarnished prose, is an excruciatingly detailed and seemingly subjective assessment of Mr. Biden’s faulty memory that overshadowed his conclusion: Mr. Biden, unlike former President Donald J. Trump, should not face criminal charges.

The Hur report underlines the challenges of deploying special counsels, which are intended to shield prosecutors from political meddling, but often result in the release of negative information about high-profile targets who have been cleared of criminal wrongdoing. It also showed the complicated balance of the job — navigating a polarized environment that leaves little option but to expansively explain the rationale for any decision.

Mr. Hur is no stranger to high-wire investigations and legal conflict. Under the Trump administration, he spent 11 months as the top aide to the deputy attorney general, Rod J. Rosenstein — as Mr. Rosenstein oversaw the appointment of the special counsel, Robert S. Mueller III, to investigate Mr. Trump’s connections to Russia.

Mr. Hur’s critics say he broke through guardrails intended to avoid tarnishing politicians facing tough elections. That was perhaps best exemplified by the F.B.I. director James B. Comey’s public condemnation of Hillary Clinton’s handling of government secrets, delivered in the months before the 2016 election.

Among the thousands of sentences in the Hur report, one juts out like a dagger: “Mr. Biden would likely present himself to a jury, as he did during our interview with him, as a sympathetic, well-meaning, elderly man with a poor memory,” he writes.

It is not unusual for witnesses in federal cases to cite their faulty recollections, particularly about events occurring years earlier, in interviews with investigators. But Mr. Hur included references to Mr. Biden’s memory that did not relate directly to retention of classified documents — including the president’s struggle to recall the year (2015) when his son Beau died, a shattering event in his life.

Those revelations, immediately seized upon by Trump supporters, were seemingly at odds with the purview of Mr. Hur’s job as special counsel, according to critics.

“Special Counsel Hur report on Biden classified documents issues contains way too many gratuitous remarks and is flatly inconsistent with long standing DOJ traditions,” Eric H. Holder Jr., President Barack Obama’s attorney general, wrote on social media, reflecting a widening sense that the disclosure inflicted political damage on the president.

Anthony Coley, Mr. Garland’s spokesman when Mr. Hur was appointed, said the focus on Mr. Biden’s memory crossed a line.

“He was supposed to be an umpire calling balls and strikes,” said Mr. Coley, who interacted with Mr. Hur at the department. “But the editorializing — the excessive, unnecessary commentary about an uncharged individual — felt like political potshots.”

A spokesman for the special counsel declined to comment.

Current and former department officials said Mr. Hur’s narrative was probably motivated by self-preservation. He needed to justify his decision not to charge Mr. Biden when the government had indicted Mr. Trump for similar, albeit far more serious, transgressions, they said. (Mr. Hur said Mr. Biden shared the content of his handwritten notebooks, which contained references to classified material, with his ghostwriter.)

And while he has mostly operated in private, that will soon end. Mr. Hur is expected to testify about his findings before Congress, where Republicans will almost certainly accuse him of applying a “two-tiered” standard of justice that favored Mr. Biden and punished Mr. Trump.

Mr. Garland, for his part, could have redacted portions of the report that he deemed inappropriate, or were flagged for national security concerns.

But he chose not to, in keeping with the practice of attorneys general not to intervene with special counsels, and because department officials think the material would be aired during Mr. Hur’s congressional testimony anyway, according to a person familiar with their thinking, speaking on the condition of anonymity to discuss details of the investigation.

The report was likely to do little to improve Mr. Garland’s standing among members of Mr. Biden’s inner circle, who have been frustrated by his deliberative approach to the Trump investigations.

The federal regulations governing special counsels include few explicit instructions on how a final report should be drafted.

The firestorm over Mr. Hur’s findings also reflected serious, perhaps irreconcilable, problems with department rules governing special counsels, independent investigators intended to shield political appointees from accusations of political interference.

Justice Department practice dictates that prosecutors “speak through filings” — criminal complaints filed against defendants, rather than in public statements.

But if a special counsel chooses not to indict someone, they are, in a sense, obligated to disclose unflattering behavior that falls short of criminality to explain why they have not brought charges, as was the case with Robert S. Mueller III’s investigation into Mr. Trump’s connections to Russia.

Mr. Hur’s executive summary, which contains many of the most quotable characterizations about Mr. Biden’s memory and age, reads like a standard internal department memo drafted to justify a non-prosecution decision, former prosecutors said. Those are typically circulated inside the department and provide an unvarnished assessment of the likelihood of a case passing muster with a jury.

But Bob Bauer, Mr. Biden’s personal lawyer, thought Mr. Hur went over the line, and accused him of disregarding Justice Department “regulations and norms” and compared the special counsel’s conduct to that of Mr. Comey, who came under fire over his sharp criticism of Mrs. Clinton.

In a letter included in the appendix of the report, Mr. Biden’s lawyers called the inclusion of discussion of Mr. Biden’s memory “pejorative.” The five-hour interview with the president, they noted, had taken place shortly after the Oct. 7 terrorist attacks on Israel, after Mr. Biden had spent hours on the phone with foreign leaders.

Mr. Hur was Mr. Trump’s pick to run the U.S. attorney’s office in Maryland, where he earned praise from the state’s Democratic senators for his handling of violent crime and public corruption cases.

Mr. Hur, who has been listed as a registered Republican in Maryland, completed his undergraduate degree at Harvard and received a law degree from Stanford.

But it was his time working with Mr. Rosenstein, then the deputy attorney general, that may have best prepared him for his current role.

Mr. Hur helped run the day-to-day operations of the department during a period of major tumult: From mid-2017 to late 2018, Mr. Rosenstein was under threat of being fired by Mr. Trump over his decision to appoint Mr. Mueller, which the president considered a personal betrayal.

“We were coming under tremendous criticism from the commentators — and the president — and Rob kept his head down, pushed ahead and never lost his sense of humor,” Mr. Rosenstein said in an interview after Mr. Hur’s appointment was announced.

“Every special counsel starts with a sterling reputation, but no one finishes up that way,” he said at the time.

Biden won’t be charged in classified docs case; special counsel cites instances of ‘poor memory’

WASHINGTON — Special counsel Robert Hur has declined to prosecute President Joe Biden for his handling of classified documents but said in a report released Thursday that Biden’s practices “present serious risks to national security” and added that part of the reason he wouldn't charge Biden was that the president could portray himself as an "elderly man with a poor memory" who would be sympathetic to a jury.

“Our investigation uncovered evidence that President Biden willfully retained and disclosed classified materials after his vice presidency when he was a private citizen,” the report said, but added that the evidence “does not establish Mr. Biden’s guilt beyond a reasonable doubt.”

The report from Hur — who previously appointed by former President Donald Trump as one of the country's top federal prosecutors — also made clear the "material distinctions" between a theoretical case against Biden and the pending case against Trump for his handling of classified documents, noting the "serious aggravating facts" in Trump's case.

Biden said in remarks from the White House after the report was made public that he was pleased that the report cleared him.

"The decision to decline criminal charges was straightforward," Biden said.

He also said: “My memory’s fine.”

Hur’s report included several shocking lines about Biden’s memory, which the report said “was significantly limited” during his 2023 interviews with the special counsel. Biden’s age and presentation would make it more difficult to convince a jury beyond a reasonable doubt that the now-81-year-old was guilty of willfully committing a crime.

“We have also considered that, at trial, Mr. Biden would likely present himself to a jury, as he did during our interview of him, as a sympathetic, well-meaning, elderly man with a poor memory,” it said. “Based on our direct interactions with and observations of him, he is someone for whom many jurors will want to identify reasonable doubt. It would be difficult to convince a jury that they should convict him — by then a former president well into his eighties — of a serious felony that requires a mental state of willfulness.”

Later in the report, the special counsel said that the president’s memory was “worse” during an interview with him than it was in recorded conversations from 2017.

“He did not remember when he was vice president, forgetting on the first day of the interview when his term ended (‘if it was 2013 — when did I stop being Vice President?’), and forgetting on the second day of the interview when his term began (‘in 2009, am I still Vice President?’),” the report said.

Biden also had difficulty remembering the timing of his son Beau’s death, as well as a debate about Afghanistan, the report said.

“He did not remember, even within several years, when his son Beau died,” the report said.

Defenders of the president quickly pointed out that he sat for the interview in the days after Hamas’ Oct. 7 attack on Israel. Biden, giving previously scheduled remarks on Thursday, appeared to nod to that, saying, “I was in the middle of handling an international crisis.”

He also added that he was “especially pleased” that the special counsel “made clear the stark differences between this case and Donald Trump.”

Andrew Weissman, who served on special counsel Robert Mueller’s team, said Thursday on MSNBC that Hur’s decision to lodge criticisms of Biden’s memory problems was “gratuitous” and reminded him of when former FBI Director James Comey held a news conference criticizing Hillary Clinton in the months before the 2016 election.

“This is not being charged. And yet a person goes out and gives their opinion with adjectives and adverbs about what they think, entirely inappropriate,” he said. “I think a really fair criticism of this is, unfortunately, we’re seeing a redux of what we saw with respect to James Comey at the FBI with respect to Hillary Clinton in terms of really not adhering to what I think are the highest ideals of the Department of Justice.”

In a Monday letter to Hur and his deputy special counsel, Richard Sauber and Bob Bauer, Biden’s personal counsel, disputed how the report characterized the president’s memory.

“We do not believe that the report’s treatment of President Biden’s memory is accurate or appropriate,” Sauber and Bauer wrote in the letter, which was also released on Thursday. “The report uses highly prejudicial language to describe a commonplace occurrence among witnesses: a lack of recall of years-old events.”

Separately, Sauber responded to the report by saying the White House is “pleased” it has concluded and that there were no criminal charges.

“As the Special Counsel report recognizes, the President fully cooperated from day one,” he said in a statement. “His team promptly self-reported the classified documents that were found to ensure that these documents were immediately returned to the government because the President knows that’s where they belong.”

Sauber went on to appear to criticize the report but raised no specific points.

“We disagree with a number of inaccurate and inappropriate comments in the Special Counsel’s report,” Sauber said in his statement. “Nonetheless, the most important decision the Special Counsel made — that no charges are warranted — is firmly based on the facts and evidence.”

Hur’s report said there were “clear” material distinctions between a potential case against Biden and the pending case against Trump, noting that unlike “the evidence involving Mr. Biden, the allegations set forth in the indictment of Mr. Trump, if proven, would present serious aggravating facts.”

Most notably, the report said, “after being given multiple chances to return classified documents and avoid prosecution, Mr. Trump allegedly did the opposite.” In contrast, it said, “Mr. Biden turned in classified documents to the National Archives and the Department of Justice, consented to the search of multiple locations including his homes, sat for a voluntary interview, and in other ways cooperated with the investigation.”

Some of the report focuses on documents about Afghanistan, from early in Barack Obama’s presidency. About a month after Biden left office as vice president, in a recorded conversation with his ghostwriter in February 2017, Biden remarked that he “just found all this classified stuff downstairs,” the report said. He told him, “Some of this may be classified, so be careful," in one recording. Biden was believed to have been referring to classified documents about the Afghanistan troop surge in 2009, which Biden opposed.

The announcement tops off a lengthy saga that began in November 2022, after one of Biden’s personal attorneys found classified documents that appeared to be from the Obama administration at the Penn Biden Center for Diplomacy and Global Engagement, which Biden had used as a personal office after his vice presidential term concluded. Classified documents were later also found at Biden’s Delaware home.

The existence of classified documents at Biden’s home and former office were first reported in January 2023. CBS News first reported the existence of the documents at the Penn Biden Center.

Attorney General Merrick Garland in January 2023 announced that he would appoint Hur as special counsel to oversee the investigation into Biden, saying the appointment authorized him “to investigate whether any person or entity violated the law in connection with this matter.”

Biden was interviewed in October as part of the investigation, the White House said. The interview was voluntary, according to White House spokesman Ian Sams.

“As we have said from the beginning, the President and the White House are cooperating with this investigation, and as it has been appropriate, we have provided relevant updates publicly, being as transparent as we can consistent with protecting and preserving the integrity of the investigation,” Sams said at the time.

NBC News has also previously reported that the special counsel had interviewed Hunter Biden as well, according to a source familiar with the matter.

With Hur’s announcement, Donald Trump remains the only president in history to face criminal charges, which include seven criminal charges in connection with mishandling classified documents found at Mar-a-Lago. According to the indictment in that case, Trump had more than 100 classified documents at his Florida home, including documents with “Top Secret” classification markings.
